What is the Digital Services Act (DSA)?

Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC ("Digital Services Act") sets out rules for online intermediaries and platforms, such as online marketplaces, social networks, and platforms for booking travel, accommodation, or outdoor activities. Its main objective is to prevent illegal and harmful activities online — such as hate speech, fraud, and disinformation — and to make the internet safer for all users.

Ototrak has designated a single point of contact to enable direct communication with the competent authorities of the Member States of the European Union, the European Commission, and the European Board for Digital Services in matters related to the application of the Digital Services Act.

Single Point of Contact for Recipients of the Service

Ototrak has designated a single point of contact to enable direct communication with recipients of the service regarding the application of Regulation (EU) 2022/2065 (Digital Services Act).

Ototrak does not rely on automated tools for direct communication. In case of change to our electronic mail address or the means of communication, we will promptly update the data available on our web site. Illegal content notices

We facilitate any individual to notify us of presence of certain information on our website which you consider to represent illegal content. You can submit all such notices to our email address info@ototrak.com. In order for us to be able to properly process the notice, please include in your notice the following:

  1. a sufficiently substantiated explanation of the reasons why you allege the information in question to be illegal content;
  2. a clear indication of the exact electronic location (such as the exact URLs) and where necessary, additional information enabling the identification of the illegal content;
  3. your name and email address, except in the case of information considered to involve one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU; and
  4. a statement confirming the bona fide belief that the information and allegations contained in the notice are accurate and complete.

We will provide you, without undue delay, with confirmation of any duly received complete notice, and we will also inform you (where the relevant electronic contact details are available to us) of any decision in respect of the information to which the notice relates, as well as of the possibilities for redress in respect of that decision.

Any notice received concerning such content will be reviewed without undue delay and in accordance with the provisions of Regulation (EU) 2022/2065 (Digital Services Act).

This decision will include a clear and specific statement of reasons to any affected recipients of the service (in line with the Digital Services Act) for any of the following restrictions imposed on the ground that the information provided is illegal content or incompatible with our Terms and Conditions:

  1. any restrictions of the visibility of specific items of information provided by the recipient of the service, including removal of content, disabling access to content, or demoting content;
  2. suspension, termination or other restriction of monetary payments;
  3. suspension or termination of the provision of the service in whole or in part;
  4. suspension or termination of the recipient of the service's account.

Additionally, if we become aware—through our own review—of any content that is illegal or contrary to these Terms, we will moderate such content in accordance with our terms and conditions and applicable regulations.

The name and email address of the person submitting a notice are used solely for purposes prescribed by law and are retained for a period of six months from the date of submission, unless further legal action is pursued.
